These Terms & Conditions ("Terms") govern your use of the Pestii Technician mobile application (the "App") provided by Pestii ("Pestii", "we", "us" or "our"). By signing in to or using the App, you agree to these Terms. If you do not agree, do not use the App.
The App is provided to pest control companies that subscribe to Pestii ("Service Providers") for use by their authorized technicians and staff. You may use the App only with an account issued to you by a Service Provider, or through the demo mode we make available. Your use is also subject to the agreement between Pestii and your Service Provider, and to your Service Provider's own policies.
You agree to use the App only for legitimate work on behalf of your Service Provider. You must not:
The App is a tool for recording work. You and your Service Provider remain responsible for the accuracy of the information entered, for following product labels and regulations, and for the quality and safety of the pest control services performed. Pestii does not provide pest control services and is not responsible for how services are carried out.
Service data entered into the App (such as work orders, notes, photos and readings) belongs to your Service Provider. You grant Pestii permission to store, process and display that content as needed to operate the service for your Service Provider. How we handle personal information is described in our Privacy Policy.
Some features need access to your device camera, photos or location (for example, QR code scanning and photo tagging). You can grant or revoke these permissions in your device settings. Some features will not work without them.
The App needs an internet connection to sync data. Work recorded while offline may not be saved to your Service Provider's account until your device reconnects. Avoid uninstalling the App or signing out while you have unsynced work.
The App, including its design, software, logos and content (excluding Service Provider data), is owned by Pestii and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for its intended purpose while your account is active.
We may update, change or discontinue features of the App at any time. We aim to keep the App available but do not guarantee it will be uninterrupted or error-free. Keeping the App updated to the latest version may be required to continue using it.
The App is provided "as is" and "as available". To the fullest extent permitted by law, Pestii disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
To the fullest extent permitted by law, Pestii will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, revenue or profits, arising from your use of or inability to use the App. Nothing in these Terms limits liability that cannot be limited under applicable law.
Your right to use the App ends when your Service Provider removes your account, when its Pestii subscription ends, or if we suspend access for breach of these Terms. Sections that by their nature should survive termination will continue to apply.
We may update these Terms from time to time. We will post the updated version on this page and change the "Last updated" date. Continuing to use the App after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any disputes will be handled by the courts located in Toronto, Ontario.
